What is a Statutory Declaration?

A Statutory Declaration or ‘Stat Dec’, as it is known in the legal world, is a formal statement confirming that something is true.   Making a false declaration is an act of perjury.

It has to be signed in the presence (witnessed) of a Solicitor, Commissioner for Oaths or Notary Public.

We cannot witness you sign a Statutory Declaration that we have prepared, but we can witness one prepared by another firm.

Some examples:

  • By people who wish to change their name as a method of legally adopting their new name so they can use it on documents such as passports and driving licences.
  • By financial institutions to transfer money to people legally entitled to deal with the estate of a person who has died, such as executors of a will.
  • Declarations of identity, solvency,  nationality or marital status when documentary evidence is unavailable.

If you would like to make a Statutory Declaration or need one witnessing by us please call or email and we will be pleased to assist.
